Changes to the end of Residence Permits for Investment

A proposal to amend the #MoreHousing programme has been submitted to the Portuguese Parliament, substantially altering the government's initial draft.

Both in the government's original proposal and in its subsequent revisions, the “PACOTE MAIS HABITAÇÃO” sought to abolish residence permits for investment (“Golden Visas”) across all eligible investment categories.

However, the proposal now put forward by the Socialist Party (PS) parliamentary group significantly changes this provision and states that residence permits will only cease to be granted in the following cases:

Under subparagraphs (i), (iii), and (iv) of paragraph (d) of Article 3(1) of Law No. 23/2007, of 4 July, meaning that the following forms of investment will no longer qualify for a Golden Visa:

  1. The transfer of capital amounting to €1.5 million or more.
  2. The purchase of real estate valued at more than €500,000.
  3. The purchase of property for urban regeneration purposes.

If this scenario is confirmed, the remaining residence-by-investment options will remain valid, including:

  • Subparagraph (ii): Creation of at least 10 jobs.
  • Subparagraph (vii): "Transfer of capital amounting to €500,000 or more, intended for the acquisition of investment fund units or venture capital funds aimed at the capitalisation of companies, established under Portuguese law, with a maturity of at least five years at the time of investment, and at least 60% of the investment value being allocated to commercial companies based in Portugal."
